PRELIMINARY VERSION — under legal review and may change; the version number below is updated with every change.
Version: 2026-10-17-draft
These terms set out how we take a request on purago.app and how we arrange the carriage of your load. The price, the time and the vehicle for a particular order are agreed with you by a dispatcher over the phone.
1. Who we are and what these terms cover
Pura is the trading name of [company name] LLC (identification code [tax ID]; address: 24 Pekini Ave, Tbilisi, Georgia). In this text “we” means that company, and “you” means whoever sends us a request or orders carriage from us.
The terms apply to requests sent through the forms on purago.app and to orders agreed with a dispatcher. We work on carriage by road, within Georgia and on international routes. If something agreed with the dispatcher for a particular order differs from this text, what was agreed applies.
[LEGAL] T1. Our legal role has to be established: freight forwarder (Articles 730–743 of the Civil Code), carrier (Articles 668–708) or intermediary (Article 744). The whole liability regime depends on it. The facts: we agree the price, we issue the invoice, and we contract with the carrier in our own name.
2. How the service works
- You send a request through the form, or call us. A request is free and does not commit you to paying.
- A dispatcher calls you back within 2 working hours. Working days are Monday to Friday; working hours are [hours].
- On the call we agree the price, the loading time and the type of vehicle. The order is confirmed once you have agreed the price and the time with the dispatcher by phone.
- We find a carrier and book the truck. The carriage is performed by a carrier we choose and contract with in our own name.
- After the load is delivered we send you an invoice, and you pay by bank transfer.
[LEGAL] T2. The contract is concluded by phone. To establish: whether the agreement needs confirming in writing (SMS or email); and, for individuals, what information the Law on the Protection of Consumer Rights requires before a distance contract (Articles 10 and 12). Under Article 14(k) of that Law the 14-day right of withdrawal does not cover a contract for the carriage of goods with a set performance date — to be confirmed.
3. Price
The dispatcher works out the price from the distance, the type of vehicle, the weight and volume of the load, the loading date and the conditions on site. Prices are in lari.
The price is agreed before loading. As long as the details of the load do not change, the agreed price does not change either.
The price covers the truck and the driver on the agreed route. Posting a request and the dispatcher’s service are free.
Our company is not VAT-registered, so no VAT is added to the price.
[LEGAL] T3. The VAT status is unconfirmed — the same sentence is on the FAQ page, and it may change with the company’s registration. Also to confirm: which rule obliges us to quote prices in lari.
4. Payment
We send the invoice after the load is delivered, to an individual and to a company alike. To invoice a company we need its name and identification code.
Payment is by bank transfer, within [N] calendar days of the date of the invoice; the term is also stated on the invoice. You pay nothing in advance.
[LEGAL] T4. The payment term is to be decided (a commercial decision). The consequence of late payment — a penalty or interest — is deliberately left out of the text; whether one is needed has to be decided.
5. What we undertake
- to call you back within 2 working hours;
- to provide a vehicle of the agreed type at the agreed time;
- to choose the carrier with due care;
- to keep a dispatcher in contact with the driver, and to call you if there is a delay;
- to send you the invoice after delivery;
- to review a claim and answer it.
[LEGAL] T5. The extent of our obligations depends on our role (T1). The law requires a forwarder to act with the care of a diligent forwarder (Article 731 of the Civil Code).
6. What you undertake
- Give us accurate details: the loading and delivery addresses, what the cargo is and what it weighs, its volume or dimensions if you have them, and a contact number at each end.
- Tell us everything that affects loading: the floor, whether there is a lift, the approach road, the warehouse opening hours.
- If the cargo is fragile, hazardous or needs a particular temperature, tell us in advance. Pack fragile cargo before loading.
- Have the cargo ready at the agreed time, packed so that it withstands the journey.
- If you are selling the goods, or moving them as part of a business, a waybill has to be issued on rs.ge before transport starts. It is issued by the supplier of the goods, or by the owner when someone is moving their own goods.
- Do not hand over cargo whose carriage is prohibited by law.
- Check the cargo together with the driver at delivery.
Costs and damage caused by inaccurate or incomplete details are yours to bear.
[LEGAL] T6. The waybill: who has to issue it when we arrange the carriage and never own the goods is still to be established. Liability for inaccurate details rests on Articles 675, 678, 691 and 732 of the Civil Code.
7. Loading and waiting
[Loading and unloading are your side. If you need loaders, tell the dispatcher. That costs an extra [X] ₾.]
[The price includes [N] minutes of waiting at loading and the same at delivery. After that, every hour started costs [X] ₾.]
If the truck is late, the dispatcher is in contact with the driver and calls you. You can also call us: +995 599 030 091.
[LEGAL] T7. The two sentences in square brackets are not decided yet (who loads, the price of loaders, free waiting time and the waiting charge). That is a commercial decision; the lawyer should check the wording.
8. Changes and cancellation
To change the date or the address, call the dispatcher. If the change affects the distance, the type of vehicle or the loading time, the price may change; we agree the new price with you before the change is made.
You can cancel an order:
- before the truck is booked — free of charge;
- after it is booked — for a fee of [X] ₾;
- once the truck has reached the loading point — for a fee of [Y] ₾.
The dispatcher tells you the exact amounts before booking.
If we cannot provide the truck at the agreed time, we tell you at once and offer another truck or another time. In that case cancelling costs you nothing.
[LEGAL] T8. The cancellation fees are to be decided (a commercial decision). Their validity needs assessing, especially against an individual (Article 22 of the Law on the Protection of Consumer Rights). The last paragraph is a new promise: it is not on the FAQ page.
9. Delivery and claims
Check the cargo together with the driver at delivery. Visible damage is written into the handover act on the spot.
A claim for hidden damage must be made in writing within 7 days of delivery.
Send the claim to info@purago.app or to the address above. Give the order number, describe the damage, and attach photographs and the handover act. We answer within [N] working days.
[LEGAL] T9. Time limits. Seven days matches Article 698 of the Civil Code (damage not apparent from outside, in writing), but Article 738, in the chapter on forwarding, sets 3 days — which one applies depends on T1. For late delivery the Code sets 21 days (Article 698(3)), and the limitation period is one year (Article 699); the text states neither. The time for answering is a new promise.
10. Liability for the cargo
Liability for loss of or damage to the cargo and for late delivery is governed by the Civil Code of Georgia (its rules on carriage) and, for international carriage, by the Convention on the Contract for the International Carriage of Goods by Road (CMR).
The carrier is liable for the cargo from the moment it takes it over until delivery. There is no liability where the damage was caused by your fault or your instruction, by defective packing, by loading or unloading that you carried out, by the nature of the cargo itself, or by circumstances that could not be avoided.
You send the claim to us; we take it up with the carrier.
[LEGAL] T10. The liability framework. Domestic carriage: Articles 686–697 of the Civil Code; under Article 708 an agreement contrary to that chapter is void. International: the CMR, with a limit of 8.33 SDR per kilogram (Article 23); the site now says we carry out both domestic and international carriage (2026-10-17). To establish: what liability we ourselves bear towards you (T1), and whether a forwarder’s duty to insure (Article 735) applies to us.
11. Limits of liability
To the extent the law allows, we are not liable for indirect loss or lost profit. Nor are we liable for a delay caused by circumstances beyond our control: the weather, a road closure, an accident, a decision of a state body.
This section does not limit liability for intent or gross negligence, and it does not take away rights the law gives you mandatorily — including consumer rights, if you use the service for personal needs.
The distances, vehicle parameters and other figures on the site are for information; the price and the terms are confirmed by the dispatcher.
[LEGAL] T11. The validity of this limitation needs assessing: Articles 697, 708 and 742 of the Civil Code; Articles 21–22 of the Law on the Protection of Consumer Rights (unfair standard terms).
12. For carriers
Registration is free. The form passes your number to the dispatchers; a dispatcher adds you to the roster after a call. We do not promise loads: loads are allocated by a dispatcher over the phone.
For every carriage a separate transport order is drawn up before loading, stating the route, the cargo, the rate and the payment term. That order sets the terms of the carriage.
[LEGAL] T12. The transport order template is being prepared separately and carries its own questions (the CMR limit, the 10% withholding for a non-resident carrier, the absence of a penalty). This text does not replace it.
13. Personal data
How we process your data is set out in the Privacy Policy.
14. Governing law and disputes
These terms are governed by the legislation of Georgia. We first try to settle a dispute by negotiation; if that fails, it is heard by the Tbilisi City Court.
[LEGAL] T13. Governing law and jurisdiction follow the transport order template (Georgian legislation, the courts of Tbilisi). To check: whether a jurisdiction agreement with an individual is permissible.
15. Changes to these terms
We may change the terms. A new version is published on this page under its own number. Your order is governed by the version in force when the order was confirmed. When a form is sent we record which version you agreed to.
The text exists in Georgian, English and Russian. If they differ, the Georgian text prevails.
[LEGAL] T14. How changes are notified, which language version prevails, and the distance-contract requirements for individuals (T2).
